We take the protection of your personal data seriously. In this privacy policy, we would like to inform you in detail about which data we collect, process and use from the user of our website and for what purposes.

1. who is responsible for your data?

The notary is responsible for the lawful collection, processing and use of your data.

2 What data do we collect and for what purposes?

2.1 Usage data

When you visit our website, our servers automatically store various data. This includes

  • Date and time of the request,
  • Name of the requested file,
  • Page from which the file was requested,
  • the browser type and version used,
  • the operating system used,
  • Access status (file transferred, file not found, etc.),
  • Complete IP address of the requesting computer,
  • If applicable, the link that brought you to the page,
  • amount of data transferred.

We use this usage data to make our website accessible to you, to identify and rectify any technical problems that may occur and to prevent and, if necessary, prosecute any misuse of our services. In addition, we use usage data in anonymized form, i.e. without the possibility of identifying you as a user, for statistical purposes and to improve our website.

2.2 Legal basis

The legal basis for the processing of your data is Art. 6 para. 1 lit. b), c), e) and f) of the General Data Protection Regulation (GDPR) in conjunction with Art. 4 of the Bavarian Data Protection Act (BayDSG) and §§ 3 ff. Rhineland-Palatinate State Data Protection Act (LDSG).

2.3 Data that you transmit to us

We use all personal data that you transmit to us exclusively to process your inquiries.

2.3.1 E-mail/fax/calls

You have the option of contacting us. If you write us an e-mail or send us a fax, the following personal data will be processed by you:

  • Master data (including title, first name and surname)
  • Contact details (e-mail address/fax number, address/telephone number if applicable)
  • Your text message

The same applies if you call us and wish us to process your request. The legal basis for this data processing is Art. 6 para. 1 lit. b) GDPR.

2.3.2 Online forms

Our website is linked to a button for online data collection, which gives you the opportunity to send us data via an online form. If you use this online service from NotarNow (LegalNow GmbH, Lena-Christ-Straße 2, 82031 Grünwald, Germany), your details, including the contact details you provide there, will be automatically stored on the NotarNow servers for a short time for the purpose of processing the request and in the event of follow-up questions and then forwarded to us. Data transmission is encrypted using transport encryption via Secure Socket Layer (SSL/TLS).

The data is stored solely for the purpose of processing or contacting the data subject. The data will not be passed on to other third parties. The legal basis for the processing of the data is Art. 6 para. 1 lit. b GDPR, provided that your request is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the inquiries addressed to us (Art. 6 para. 1 lit. f GDPR) or on your consent (Art. 6 para. 1 lit. a GDPR), if this has been requested.

We will retain the data you provide on the online form until you request its deletion, revoke your consent for its storage, or the purpose for its storage no longer pertains (e.g. after fulfilling your request). Mandatory statutory provisions - in particular retention periods - remain unaffected.

When using the "cache" function, your online form entries are encrypted and stored anonymously for 30 days. If the online form is not sent to us within these 30 days, the form entries will be deleted automatically. A request for deletion on your part is not necessary in this case.

3. cookies

Our websites use cookies. "Cookies" are small text files that are stored on your data carrier and exchange certain settings and data with our system via your browser. A cookie usually contains the name of the domain from which the cookie data was sent, as well as information about the age of the cookie and an alphanumeric identifier.

Cookies enable us to make the website appealing to you and make it easier for you to use, for example by saving certain entries you make so that you do not have to keep repeating them.

We use so-called session cookies: Session cookies (also called session cookies) are deleted after you close your browser. A session cookie is set when you log into a protected area on our website.

The information stored in the cookies is not used by us to identify you. They are also not merged with other personal data that we have stored about you.

If you do not wish cookies to be used, you can set your browser so that the storage of cookies is not accepted. Please note that in this case you may only be able to use our website to a limited extent or not at all.

If third-party content is integrated, there is a possibility that additional cookies (in particular so-called long-term cookies, i.e. cookies that remain on your computer's hard disk for a certain period of time) may also be set. If you only want to accept our cookies, but not the cookies of third parties, you can select the settings in your browser "Block third-party cookies".

4. use of Google Maps

Google Maps API, a map service of Google Inc ("Google"), is integrated on our website to display an interactive map. By using Google Maps, information about your use of this website (including your IP address) may be transmitted to a Google server in the USA and stored there.

It would be technically possible for Google to identify at least individual users on the basis of the data received. It is possible that personal data and personality profiles of users of the website could be processed by Google for other purposes over which we have and can have no influence.

You have the option of deactivating the Google Maps service in a simple manner and thus preventing the transfer of data to Google: To do this, deactivate JavaScript in your browser. However, we would like to point out that you will not be able to use the map display in this case.

5. integration of YouTube content

Content from the third-party provider YouTube is embedded on our website. By default, only deactivated images from the YouTube channel are embedded, which do not establish an automated connection with YouTube's servers. This means that the operator does not receive any data from the user when the websites are accessed.

You can decide for yourself whether the YouTube videos should be activated. Only when you start playing the videos by clicking on the "Play" button do you give your consent for the necessary data (including the Internet address of the current page and the user's IP address) to be transmitted to the operator.

We set a cookie to save the setting requested by the user. When these cookies are set, however, we do not store any personal data; they only contain anonymized data to adapt the browser. The videos are then active and can be played by the user. If you would like to deactivate the automatic loading of YouTube videos again, you can uncheck the consent box under the data protection symbol. This will also update the cookie settings.

By using YouTube, information about your use of this website (including your IP address) may be transmitted to a Google server in the USA and stored there.

6. when do we pass on data to third parties?

Your personal data will only be transferred to third parties for purposes other than those listed here if you expressly consent to this or if we are obliged to do so by law or an official or court order.

In accordance with Art. 28 GDPR, all processors are contractually obliged to take technical and organizational measures to ensure the protection of your personal data.

7 Where is my data stored?

The processing of your personal data by us takes place exclusively in data centers in Germany.

8. how long will my data be stored?

Personal data will be deleted when it is no longer required for the purposes described in this declaration, unless statutory provisions require longer storage.

9. what rights do I have with regard to the processing of my data?

You and all other persons who may be affected by the use of data by us have a right to information about the personal data stored by us and, if the respective legal requirements are met, a right to confirmation, correction, deletion or restriction of processing.

You and the other data subjects also have the right to receive the personal data concerning you in a structured, commonly used and machine-readable format. This includes the right to transmit this data to another controller. Where technically feasible, you and the other data subjects may also request that we transmit the personal data directly to the other controller from the aforementioned point in time.

To exercise the rights mentioned in this section and in the event of questions and complaints regarding the use of your personal data, you and the other persons concerned can contact our data protection officer in confidence at any time via the notary's office.
